In consideration for the value received, the receipt and sufficiency of which is hereby acknowledged, Releasor hereby releases and forever discharges and holds harmless Central Garden & Pet Company, its subsidiaries, related and/or affiliated companies, shareholders, directors, divisions, agents, officers, employees, successors, and heirs (individually and collectively “Central”) from and against any injuries, harm, damages, costs, expenses, losses, liabilities, lawsuits, actions, claims, and/or demands whatsoever arising out of any lawful use of: (A) my comments/quotes/testimonial regarding Central product(s) and/or regarding my participation in a Central-sponsored event and/or my comments/quotes provided to Central at an event at which Central was present (a “Testimonial”); (B) arising out of any lawful use of any video/photographic portraits/images or pictures of me and/or my animal(s), or in which I and/or my animal(s) may be included in whole or part, or composite or distorted in character or form, in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, which portraits or pictures or video as were made through any media at its studios or elsewhere (a “Portrait”); and/or (C) the photograph(s), attached hereto, in which I own all rights, title and interest (individually, and collectively, “Photograph”). I hereby acknowledge that I took the Photograph, that I own all rights to this Photograph, and that I have obtained a release from the owner of any premises/animals depicted in the Photograph. Central shall have the absolute right and all permission necessary to: (a) copyright, publish, reprint, and/or edit any Testimonial of Releasor; and (b) copyright, publish and/or reprint any Portrait, and/or Photograph of Releasor (including, but not limited to, stories concerning the Releasor’s property or which use Releasor’s picture, portrait or likeness or any picture, portrait or likeness of Releasor’s property or comments to Central employees or reports of field study results) written or otherwise. Releasor understands that any such Testimonial, Portrait, and/or Photograph shall be the property of Central and may be used, or caused to be used, in Central’s sole discretion, for any and all exhibitions, public displays, publications, commercial art, advertising, trade, and any other lawful purpose whatsoever, without any limitation or reservations, and without any compensation to Releasor. Releasor hereby waives any right that Releasor may have to inspect and/or approve the finished product or advertising copy that may be used in connection therewith or the use to which it may be applied. Releasor must be eighteen (18) years of age or older.
