We’d therefore like to officially request the right to your use your UGC (“User Generated Content” – “UGC”). Thanks a lot for considering our request!
1) From time to time, we get in touch with our customers to request their permission to reproduce high quality UGC on our website, store, email, and social media channels, or to use it for other marketing purposes.
If you grant us your permission to use your UGC in the extent described below, we’ll credit your post by including your Instagram handle on our website. We will also aim to post your account name when using your content across other marketing channels so that our followers know who’s behind the great UGC!
2) By responding to this usage rights request with the hashtag #yesjuniqe or #yesjunique you are agreeing to the following licensing terms:
GRANT OF RIGHTS You hereby grant to us and our affiliates a non-exclusive, free, timely and locally unlimited right to use your UGC for all marketing purposes, online and offline, especially in advertisements, for example our catalogs, in store, email and all other communications including business to business as well as business to consumer relationships, especially to save, reproduce, display, distribute, make publicly available and - while respecting Section 14 German copyright act - alter and edit your UGC. (“Licence”).
The license is:
“non-exclusive” meaning you may use the UGC for your own purposes or let others use your UGC for their purposes “free” meaning free of any charges. We do not owe you anything in connection with our use of your UGC “timely unlimited” meaning that you grant us the license for an indefinite period of time “locally unlimited” meaning we may exercise our rights anywhere in the world Our “Affiliates” are limited to our partner shops, resellers and affiliated companies pursuant to Section 15 of the German Stock Corporation Act.
YOU PROMISE US that you have the right to grant us the License in the extent described above; that you have permission from all person(s) pictured in your UGC, that the UGC in which they are pictured can be used in the extent described above; that you have paid and will pay in full any fees or other payments that may be related to the use of your UGC; your UGC does not infringe any legal rights of any third party, for example intellectual property rights or privacy rights; You as an individual are at least eighteen (18) years of age or as a legal representative agree to the License in the extent described above. We reserve the right to stop using your UGC for any reason and remove it from our marketing channels without any notification or replacement.
To this agreement GERMAN Law (to the exclusion of the UN Convention on Contracts for the International Sale of Goods) is solely applicable. If you are a consumer, this choice of law is only applicable insofar as mandatory consumer laws in the state where you have your usual whereabouts remain unaffected.
If you are a merchant, an entrepreneur within the meaning of Section 14 of the German Civil Code or a legal person under public law or a special fund under public law or you have no residence in Germany or your whereabouts are unknown, the exclusive - and international - place of jurisdiction for all legal disputes because of or in connection with this agreement is our place of business.

1) Von Zeit zu Zeit setzen wir uns mit unseren Kunden in Verbindung, um sie um Erlaubnis zu fragen, unseren Lieblings-UGC zu reproduzieren und darüber hinaus auf unserer Website, in Emails, Social Media und im Store zu integrieren oder für anderen Marketingzwecken verwenden zu dürfen.
Solltest du uns gestatten, dieses Foto im nachfolgend beschriebenen Umfang zu benutzen, werden wir deinen Account-Namen auch auf unserer Website nennen, damit jeder weiß, wessen toller UGC das ist. Wir würden uns außerdem darum bemühen, deinen Account-Namen zu posten, wenn wir dein Foto in anderen Marketing-Kanälen benutzen.
2) Antworte auf diese Nutzungsrechteanfrage einfach mit dem Hashtag #yesjuniqe oder #yesjunique, um dich mit den folgenden Lizensierungsbedingungen einverstanden zu erklären:
NUTZUNGSERLAUBNIS Hiermit erteilst du uns und unseren Partnern das nicht-exklusive, kostenlose, zeitlich und örtlich unbeschränkte Recht, deinen UGC für alle Marketingzwecke, online sowie offline, insbesondere in Werbung, z.B. in Katalogen, im Store, Emails und sonstiger Kommunikation sowohl gegenüber Unternehmern, als auch Verbrauchern zu nutzen, insbesondere Deinen UGC zu speichern, zu reproduzieren, darzustellen, zu verbreiten, öffentlich zugänglich zu machen und - vorbehaltlich § 14 Urhebergesetz - abzuändern und zu bearbeiten („Lizenz“).
Die Lizenz ist:
“nicht –exklusiv“, d.h. du darfst deinen UGC zu eigenen Zwecken nutzen und kannst anderen erlauben, deinen UGC zu deren Zwecken zu nutzen; “kostenlos“, d.h. unentgeltlich. Wir schulden dir nichts im Zusammenhang mit der Nutzung deines UGC; “zeitlich unbeschränkt“, d.h. du gewährst uns die Lizenz auf unbestimmte Zeit; “örtlich unbeschränkt, d.h. wir dürften die Lizenz überall auf der Welt ausüben. Als unsere „Partner“ gelten ausschließlich unsere Partnershops, Reseller und verbundene Unternehmen im Sinne von § 15 Aktiengesetz.
DU VERSPRICHST UNS dass du das Recht hast, uns die Lizenz im vorbeschrieben Umfang einzuräumen; dass du von allen in deinem UGC abgebildeten Personen die Erlaubnis eingeholt hast, dass der UGC, in dem diese abgebildet sind, im vorbeschriebenen Umfang verwendet werden darf; dass du sämtliche Lizenzgebühren oder andere Entgelte, die mit deinem UGC im Zusammenhang stehen könnten, vollständig bezahlt hast; dass dein UGC keinerlei Rechte Dritter verletzt, z.B. Immaterialgüter oder Persönlichkeitsrechte; dass du als natürliche Person das achtzehnte (18.) Lebensjahr vollendet hast oder du als gesetzlicher Vertreter mit der Lizenz im vorgenannten Umfang einverstanden bist.
Wir behalten uns das Recht vor, die Nutzung deines UGC jederzeit und ohne Mitteilung einzustellen und diesen aus unseren Marketing Kanälen ersatzlos zu entfernen.
Auf diese Vereinbarung findet ausschließlich DEUTSCHES Recht unter Ausschluss des UN-Kaufrechts Anwendung. Wenn du Verbraucher bist, gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem du deinen gewöhnlichen Aufenthalt hast, entzogen wird. Wenn du Kaufmann, Unternehmer im Sinne des § 14 BGB oder eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen bist oder du keinen allgemeinen Gerichtsstand in der Bundesrepublik Deutschland hast oder dein Wohnsitz oder gewöhnlicher Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt sind, ist ausschließlicher – auch internationaler Gerichtsstand - für alle Streitigkeiten aus oder im Zusammenhang mit dieser Vereinbarung unser Geschäftssitz.
